辽宁省农村公路建设质量安全管理办法

（征求意见稿）

第一章 总 则

第一条 为加强我省农村公路建设质量安全管理，保障农村公路建设质量安全，根据交通运输部《农村公路建设质量管理办法》、辽宁省《辽宁省建设工程质量条例》和《辽宁省农村公路管理办法》等法规、规章及规范性文件规定，结合我省实际，制定本办法。

第二条 本办法所指农村公路，是指纳入公路规划，并按照国家或者我省有关技术标准修建的县道、乡道、村道及其桥涵、隧道和渡口。

第三条 县（含县级市，区）人民政府是农村公路建设质量安全管理责任主体，对辖区内农村公路建设质量安全负总责，并管理、考核下属交通行政部门的质量安全管理工作。

第四条 农村公路建设质量安全管理实行“政府监督、法人管理、社会监理、企业自检”的四级保证体系。建设、设计、施工、监理和试验检测单位依法对建设工程承担相应责任。农村公路建设项目应明确质量安全责任主体，落实质量安全责任，签定责任书。

第五条 农村公路建设的质量目标：所有农村公路建设技术标准和质量安全指标满足要求，工程质量鉴定合格率达100%。

第六条 农村公路建设项目按有关要求向社会公示。工地现场设置公示牌，标明工程项目名称、建设规模、建设内容、技术标准、

投资额、各从业单位及联系人、监督人员、举报电话、通讯地址及工程质量安全主要控制措施，接受社会监督。

第七条 工程建设各参建单位应按照质量通病治理和“平安工地”建设活动等要求，深入开展各项质量安全活动，推行精细化、标准化管理，提升工程建设质量安全管理水平。

第二章 交通行政部门职责

第八条 省交通行政部门依据国务院和省政府有关工程建设质量安全管理要求，制定全省农村公路工程建设质量安全监督管理规定，指导全省农村公路建设质量安全管理工作，协调农村公路建设质量安全管理中的重大事项，督促市、县交通行政部门履行质量安全管理职责，会同有关部门查处重大质量问题和重大安全事故。

第九条 市（扩权强县）交通行政部门在同级政府领导下，负责监督、指导辖区内农村公路建设质量安全管理工作，贯彻落实农村公路建设质量安全管理政策和工程技术标准，明确本地区农村公路建设各方质量安全责任、权利和义务，检查指导县交通行政部门农村公路建设质量安全管理工作。

第十条 县交通行政部门在同级政府领导下，负责辖区内农村公路建设质量安全管理与监督，应成立质监组织（县质监机构或县交通局内设质量安全监督部门）具体负责农村公路质量安全监督工作，质监人员必须满足工程质量与安全生产监督管理的技术专业要求；重点规范建设、设计、施工、监理等参建各方质量安全行为，

第十五条 质量监督期是从受理交通工程监督申请手续之日起至工程项目质量缺陷责任期（竣工验收）止；安全生产监督期是从受理建设单位安全生产条件核查备案手续之日起至交工质量鉴定止；农村公路项目质量安全监督覆盖率达到100%。

第四章 建设各方责任

第十六条 建设单位质量安全管理责任

（一）建设单位为农村公路质量安全管理责任主体，法人代表为质量安全责任人，要认真落实工程质量安全责任，严格执行有关基本建设程序，结合农村公路建设实际情况制定农村公路质量安全管理办法，成立工程质量安全管理机构（机构建设和人员素质应满足工程质量安全管理和技术要求），对设计、监理、施工单位的质量安全管理体系运行情况及工程材料、施工工艺、实体质量等进行检查。

（四）交（竣）工验收时，应检查设计文件是否得到执行并提出评价意见。

第十八条 施工单位质量安全责任

（一）施工单位对建设项目质量安全承担主体责任。（二）施工单位应按照合同文件要求配备相应施工队伍，严禁个人承揽施工任务，严禁将中标的农村公路建设项目转包和违法分包。

（三）依据设计文件和公路工程技术标准、规范和规程，按照施工合同要求，制定质量安全管理措施，编制施工组织设计；建立施工质量安全保证体系，制定和完善各项质量安全管理制度和控制措施，加强施工过程中的自检和交接检工作，接受质监机构和建设单位的检查。

（四）施工现场须配备与施工工艺相配套的设备，施工工艺须符合相应作业内容的质量控制要求。

（五）农村公路（项目单个合同段投资额在1000万元以上的）建设项目应建立符合工程要求的工地临时试验室，施工企业无检测机构的，应委托具有交通行业丙级以上等级资格且具有第三方社会服务能力（通过计量认证）的检测机构组建工地试验室。其它农村公路应当建立满足工程质量控制需求的临时简易工地试验室，检测
