Article4Prevention

1.electricalMembercontainandelectronicStatesshallequipmentensurethat,putfromonthe1marketJuly2006,doesnewbrominatedlead,(PBDE).theseNationalbiphenylsmercury,measures(PBB)cadmium,restrictingorpolybrominatedhexavalentchromium,poly-notorprohibitingdiphenyltheuseethersofweresubstancesadoptionadopted2006.

2.MemberStatesshallcommunicatetotheCommissionthetextofalllaws,regulationsandadministrativeprovisionsadoptedinthefieldcoveredbythisDirective.

Article10Entryintoforce

ThisDirectiveshallenterintoforceonthedayofitspublica-tionintheOfficialJournaloftheEuropeanUnion.

Article11Addressees

ThisDirectiveisaddressedtotheMemberStates.

MemberStatesshalldeterminepenaltiesapplicabletobreachesofthenationalprovisionsadoptedpursuanttothisDirective.Thepenaltiesthusprovidedforshallbeeffective,proportionateanddissuasive.

Article9Transposition

1.MemberStatesshallbringintoforcethelaws,regulationsandadministrativeprovisionsnecessarytocomplywiththisDirectivebefore13August2004.TheyshallimmediatelyinformtheCommissionthereof.

WhenMemberStatesadoptthosemeasures,theyshallcontainareferencetothisDirectiveorbeaccompaniedbysucharefer-enceontheoccasionoftheirofficialpublication.ThemethodsofmakingsuchareferenceshallbelaiddownbytheMemberStates.
